U.S. Customs and Trade Lawyer, Roy Delbyck, will walk you through start-to-finish documents for a hypothetical first-sale transaction involving an Asia Factory selling to an Asia Middleman selling to a US Buyer where duty is claimed on the price charged by the Asia Factory to the Asia Middleman.
Here’s some of what you’ll learn:
  • The current first-sale climate - legalities and commercial realities
  • Preparing documentation (POs, invoices, etc.) to support a first-sale claim

  • Dealing with dutiable assists for materials and product development
  • Substantiating proof of payment from Asia Middleman to Asia Factory
  • Responding to a Request For Information (CF-28) issued by US Customs for value substantiation
  • Responding to a Notice of Action (CF-29) issued by US Customs for a value advance

 About the Speaker

Roy Delbyck represents U.S. and Asian firms involved in the importation of mechandise into the United States and other export markets He advises on a wide range of customs and trade and commercial matters.  He is a member of the California Bar.

Mr. Delybck received his undergraduate degree from Connecticut College (USA), where he majored in Mandarin Chinese and graduated cum laude.  Prior to entering the law, Mr. Delbyck worked as an Office Manager and Quality Control manager in the Hong Kong and Taiwan buying offices of Bobbie Brooks, Inc., a U.S. apparel importer. He received his law degree from the University of California Davis, where he was Managing Editor of the U.C. Davis Law Review. Prior to establishing his firm in 1993, Mr. Delbyck was a partner in the Hong Kong office of Baker & McKenzie.
